GENERAL SALE CONDITIONS
1. Application of the general sale conditions
1.1 Any purchase order of products at BIOTEK srl is governed by these general sale conditions, unless BIOTEK is entitled to apply special conditions, applicable to purchases made over the internet.
1.2 BIOTEK reserves the right to modify these general terms and conditions of sale at any time by publishing a new version.
2. Orders

2.2 BIOTEK proposes the products for sale within the limits of available stock at the time of the purchase order. There is no total or per item minimum order.
2.3 The prices expressed are VAT and transport excluded. At the time of shipment the current VAT rate will be applied and the transport costs related to the order will be added.
2.4 BIOTEK reserves the right to refuse an order, set purchase limits or demand prepayment, in particular in case of outstanding invoices, credit risk or insolvency.
3. Delivery
3.1 Shipments are made through Express Courier selected by BIOTEK. Once the order has been received, accepted and processed, the time required for shipping is 2 (two) working days for Italy, standard areas served by express courier and 3 (three) to 7 (seven) days for islands or remote areas. In the case of purchase of equipment or special products, customer will be contacted to establish delivery times. When the package is sent from our warehouses, customer will receive an e-mail confirmation of shipment with a link through which you will know the exact date of delivery.
Delivery will take place from Monday to Friday excluding holidays.
Shipments abroad are subject to assessment in relation to the geographical area.
Delivery time is not including any custom clearance or delay.
3.2 If the customer, at the time of purchase, requires a delivery method different from those normally proposed by BIOTEK, BIOTEK will charge the amount of shipment within the order. For purchases made at the BIOTEK locations, the goods are delivered immediately by collection from the customer.
3.3 The risks of loss and deterioration of the goods are transferred to the customer at the time of delivery, or, in the case of transfer of goods from one place to another, to the carrier at the time of delivery. In the event of force majeure BIOTEK will not be responsible for the delay or non-delivery.
4. Verification of the goods
4.1 It is up to the customer to check, at the time of delivery, the quantity and status of the products and, in case of anomalies and / or missing items / products, to collect the goods subject to control of the content and inform BIOTEK within 7 (seven ) days from the date of receipt of the products, keeping the courier's invoice and the waybill.
4.2 After having followed all the indications of point 4.1, BIOTEK reserves the right to verify any faults or anomalies and, in agreement with the customer, will supply at its own expense products to supplement the missing or substitutive in case of damaged products or will issue a refund in case of return if the goods is returned in the original packaging, accompanied by the relative purchase invoice according to the conditions expressed in point 5.2.
5. Returns
5.1 For purchases of equipment and / or accessories made via the Internet, e-mail or telephone and in any case outside the business premises, it will always be possible to exercise the right of withdrawal based on the deadline of 14 calendar days from delivery of the goods (or of the last good for multiple orders), by contacting customer service for return methods. The goods must be returned at the expense of the consumer within 14 calendar days from the date on which the consumer himself informed BIOTEK of his decision to withdraw.
5.2 BIOTEK will only accept returns of goods in perfect condition and in their original packaging, accompanied by the relevant purchase invoice. In the event that the returns have been made in compliance with the above, BIOTEK will issue a refund via a PayPal service or bank transfer according to the payment method made by the customer at the time of purchase, within a maximum of 14 days from receipt of the return at the BIOTEK office in Milan. BIOTEK will not reimburse the shipping costs invoiced with the purchase, nor the return costs.
5.3 The return of products purchased directly from BIOTEK offices will not normally be accepted. In particular, once the BIOTEK sales office has been left, it will no longer be possible to change or exchange
6. Price and billing
6.1 The prices invoiced for the products ordered are those in force on the day of the issuing of the purchase order, including taxes and shipping costs. Shipping costs are shown separately on the invoice.
6.2 For deliveries outside Italy, the buyer will be responsible for paying the customs permits and any other taxes or expenses that may be taxed upon arrival of the goods.
6.3 BIOTEK retains the right of ownership of the delivered goods until full payment of the invoice.
6.4 All products may be subject to price changes without notice by BIOTEK.
7. Payment
7.1 For purchases made via the internet, e-mail or telephone, the corresponding invoice amount must be paid in advance by credit card, paypal or bank transfer before the goods are sent or by cash on delivery of the order. Exceptions are purchases made on site, which require the balance for the total amount at the time of collection of the goods.
7.2 Any payment by credit card is due and payable immediately. The credit card details will be encrypted during the transaction for security reasons. The identification data of the credit card (type, number and expiry date) are neither viewed nor stored by Biotek srl; in fact, these data have passed on a secure SSL connection directly to the bank that carries out the task of authorizing payment. In the case of a second credit card purchase, all card details must be re-entered.
7.3 Cash on delivery: valid only in Italy. By choosing this method, payment will be made to the express courier upon delivery of the product purchased: in addition to the amount of the product and shipping costs a contribution to cash on delivery according to the rates in force will be required. Payment must be made in cash or bank check made out to BIOTEK srl directly to the courier. Only exact amounts are accepted, corresponding to the amount of the order: there is no rest.
Cash payments will be accepted within the threshold of € 1999.00 according to the Italian legislation in force. In case of non-collection of the goods, the customer will still be charged for shipping and storage.
7.4 In case of a purchase option by bank transfer, it is specified that the payment must be made within 7 calendar days from the order. After this deadline, the order placed will be automatically canceled. Any active promotions will be applied only if payment is made during the specified period.
8. Machine warranty and after-sales assistance service
8.1 BIOTEK equipment is guaranteed for 12 months from delivery directly by the manufacturer pursuant to art. 1495 Civil Code and according to the terms and conditions in force.
8.2 Under warranty. In the unfortunate event that a Biotek machine, purchased on the Biotek e-shop or at one of the Biotek direct offices, presents a malfunction or manufacturing defect manifested within the warranty period (12 months from the date of purchase), it must be shipped at care and cost of the customer to BIOTEK Milan for the repair. Under no circumstances will it be possible to make a refund to the customer if the relevant deadlines have already expired (see point 5). The costs of returning the equipment (unless a non-compliant use of the same is identified) will be borne by BIOTEK. Consult the warranty section of your machine's user manual to find out what your warranty includes.
8.3 Out of warranty. Technical assistance interventions outside the warranty period require shipment to BIOTEK by the customer. The costs of return and technical interventions (including fault finding costs) will be charged to the customer and must be paid before processing.

9. Data protection
9.1 The data provided will be used for orders, sending commercial information, for statistical purposes and for offers reserved for BIOTEK. The data will be processed in accordance with the Personal Data Protection Code (Legislative Decree 196/2003) and will not be transferred to third parties, except to the services involved in the organization and management of transport and delivery, as used by BIOTEK.
9.2 In compliance with the art. 7 of the aforementioned Code, it will be possible at any time to request information on personal data, as well as the modification or cancellation thereof by contacting BIOTEK s.r.l. Milan.
10. Disputes
In the event of a dispute, the Court of Milan has exclusive jurisdiction.
